Separation Agreements A deed of separation or separation agreement is a document usually drafted by a professional legal adviser such as a Solicitor containing details of any arrangements agreed between a separating couple – perhaps about their assets or their children or when they will get divorced. It is very important to realise that these agreements are not finally legally binding on either party. So why bother with them then? Some people prefer to sort out what happens to their house and their bank accounts before and wait two years from separation to divorce by consent. Sometimes they do not want to have to blame each other for the breakdown in their relationship, others cannot face the finality of divorce just yet. A separation agreement shows what they have agreed about the details of the separation. When the time comes to divorce and make it all formal it should be a lot easier because all the decision making has already been taken care of. But. It is very important to make sure that: a) Your separation agreement is properly drafted by a Solicitor. b) It is signed and witnessed. c) You have the opportunity to take independent legal advice before you sign it. d) You have enough information about the other person’s finances etc to decide that it is fair.
